Central Information Commission and others This decision is an example for millions of people who expect transparency, accountability and honesty in government institutions. Let’s know the key points of this historic decision:<\/p>\n\n\n\n Job related documents will no longer be ‘confidential’:<\/p>\n\n\n\n If a person has been appointed to a public post, then his educational qualification, experience certificate, documents related to the selection process, appointment order etc. will not be considered private information.<\/p>\n\n\n\n Clear order of the court: All these documents are public information for the public and can be obtained through RTI.<\/p>\n\n\n\n The Information Commission had rejected this RTI under Sections 8(1)(h), 8(1)(j) and 11 of the RTI Act, but the court said:<\/p>\n\n\n\n “Withholding information without giving any concrete reason is a misuse of the RTI Act.”<\/p>\n\n\n\n Public interest is paramount – no compromise on transparency:<\/p>\n\n\n\n If there is a suspicion of corruption or irregularity in an appointment, the public has the right to know whether the selection process was fair or not.<\/p>\n\n\n\n These facts cannot be hidden under the guise of confidentiality.<\/p>\n\n\n\n Prohibition on misinterpretation of Section 11:<\/p>\n\n\n\n The Information Commission had refused to give information without the consent of a third party.<\/p>\n\n\n\n The court clearly said:<\/p>\n\n\n\n If the information is in public interest,<\/p>\n\n\n\n and there is no actual harm to any third person,<\/p>\n\n\n\n then his consent is not necessary.
